Supreme Court Says Family Financial Rules Are Fair

In a recent decision the Supreme Court (the highest court in the UK) decided that the financial rules for spouse and partner visa applications are (more or less) fair. These rules say that there must be a certain level of income or savings that the visa applicant will be able to rely on, and they have been challenged in the courts on the grounds that they offend human rights principles, because some people simply cannot meet the requirements.

However, the Supreme Court declined to strike the rules down as being unlawful or grossly unfair, although they did make some criticisms and demanded that the Home Office make some changes here and there. They also maintained that, in some exceptional individual cases, the rules might be too harsh.

The position taken by the Supreme Court is broadly in line with the position established by the courts in previous cases and nothing major has changed.
